1. Introduction

Welcome to ShuvoShop ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our e-commerce platform, website, mobile application, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

2. Eligibility

To use our Service, you must be at least 18 years old or have the consent of a parent or legal guardian. By using our Service, you represent and warrant that:

  • You are at least 18 years of age or have parental consent
  • You are a resident of Bangladesh or have a valid Bangladeshi address for delivery
  • You have the legal capacity to enter into a binding agreement
  • All information you provide is accurate and up-to-date

3. Account Registration

To access certain features of our Service, you may need to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information about yourself
  • Maintain and promptly update your account information
  • Maintain the security of your password and account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account
  • Use only one account per person (no duplicate accounts)

4. Orders and Payment

4.1 Order Placement

When you place an order through our Service, you are offering to purchase a product subject to these Terms. All orders are subject to acceptance and availability.

4.2 Payment Methods

We accept various payment methods including cash on delivery (COD), bKash, Nagad, Rocket, and major credit/debit cards. All payments are processed securely through our trusted payment partners.

4.3 Pricing

All prices are displayed in Bangladeshi Taka (BDT) and include applicable VAT/taxes unless otherwise stated. We reserve the right to change prices at any time without prior notice. However, prices for confirmed orders will not be changed.

4.4 Order Cancellation

We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

5. Shipping and Delivery

We deliver products throughout Bangladesh. Delivery times and charges vary based on location:

  • Dhaka City: 2-3 business days (delivery charge: BDT 60)
  • Dhaka Suburbs: 3-5 business days (delivery charge: BDT 100)
  • Outside Dhaka: 5-7 business days (delivery charge: BDT 120-150)
  • Free delivery on orders above BDT 1,500 (Dhaka only)

Delivery times are estimates and not guaranteed. We are not liable for delays caused by circumstances beyond our control, including natural disasters, political unrest, or courier service issues.

6. Returns and Refunds

We offer a 7-day return policy for most products. To be eligible for a return:

  • Product must be unused and in original packaging
  • You must have the receipt or proof of purchase
  • Product must not be on the non-returnable items list
  • Return must be initiated within 7 days of delivery

Non-returnable items include: personal care products, intimate items, perishable goods, custom-made products, and digital downloads.

Refunds will be processed within 7-14 business days after we receive and inspect the returned item. Refunds will be issued to the original payment method or as store credit.

7. User Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction (including copyright laws)
  • Transmit any viruses, malware, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Engage in any activity that disrupts or interferes with the Service
  • Use automated systems or software to extract data from the Service
  • Impersonate any person or entity
  • Post false, misleading, or fraudulent reviews or ratings

8. Intellectual Property

All content on our Service, including but not limited to text, graphics, logos, images, videos, and software, is the property of ShuvoShop or its content suppliers and is protected by Bangladeshi and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using our Service, you consent to the collection and use of your information as described in our Privacy Policy.

10. Limitation of Liability

To the fullest extent permitted by law, ShuvoShop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, or similar harmful components; or (e) any errors or omissions in any content.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiations between the parties. If a dispute cannot be resolved through negotiation, it shall be submitted to arbitration in Dhaka, Bangladesh, in accordance with the Arbitration Act, 2001. The arbitration shall be conducted in English or Bengali, and the decision of the arbitrator shall be final and binding.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh, for the resolution of any disputes.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination.
